kuieralot® Market Space Terms and Conditions

These Market Space Terms and Conditions (“Market Space Terms”) govern access to and use of the kuieralot® Market Space at kuieralot.com/market-space (“Market Space”), including the creation, publication and use of product listings.
kuieralot® Market Space is operated by KUIERALOT (PTY) LTD, trading as kuieralot® (“kuieralot”, “we”, “us” or “our”), a company registered in South Africa.
By registering as a seller, submitting or publishing a listing, contacting a seller through kuieralot® Market Space, or otherwise using Market Space, you agree to these kuieralot® Market Space Terms. If you do not agree, do not use kuieralot® Market Space.
1. What kuieralot® Market Space is
kuieralot® Market Space is an online listing and discovery platform that enables independent sellers to advertise products and enables interested buyers to find and contact those sellers. Sellers may use a free listing tier or choose a paid monthly listing tier.
Unless a page expressly states otherwise:
- kuieralot® is not the seller, supplier, buyer, reseller, agent, auctioneer or distributor of a listed product;
- kuieralot® does not own, possess, inspect or store listed products;
- kuieralot® does not set product prices;
- kuieralot® does not process or hold payment between a kuieralot® Market Space buyer and seller;
- kuieralot® does not arrange or perform delivery or collection for kuieralot® Market Space transactions; and
- kuieralot® is not a party to the sale or any other agreement concluded between a buyer and seller.
The seller is the supplier of the listed product. Any sale is concluded directly between the buyer and seller on the terms they agree, subject to applicable law.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use kuieralot® Market Space as a seller or buyer.
A seller must:
- be based in South Africa;
- list only products located in South Africa and available for lawful sale there;
- provide complete, accurate and current registration, profile and contact information;
- have the legal capacity and authority to sell every listed product; and
- hold every registration, licence, permit, approval or qualification required for its business and products.
A seller may be an individual, sole proprietor, informal trader, side-hustle operator or registered business, provided the seller complies with these kuieralot® Market Space Terms and applicable law.
If you act for a business or another person, you confirm that you are authorised to bind that business or person.
3. Accounts and security
You are responsible for keeping your login details confidential and for all activity under your account. You must promptly notify us at kuier@kuieralot.com if you suspect unauthorised access or use.
You may not create a false identity, impersonate another person or business, create accounts to evade a restriction, or allow another person to use your account in a misleading or unlawful manner.
We may request reasonable information to verify identity, age, authority, location, product ownership or legal compliance. Failure to provide it may result in restriction or suspension of the account or listing.
4. Listing tiers, fees and package changes
Market Space currently offers the following seller listing tiers:
- Dip Your Toe: up to 5 active listings at no charge;
- Make Some Space: up to 10 active listings for R29 per month; and
- Fill the Shelves: up to 20 active listings for R49 per month.
The current tiers, prices and included listing limits are also displayed on our Sell on Market Space page. Prices are stated in South African rand. The price and any applicable tax, payment frequency, renewal arrangement and other material payment information will be shown before a seller confirms a paid package. If there is a conflict, the information presented and accepted at checkout applies to that purchase, subject to applicable law.
A listing counts towards a tier limit while it is active or otherwise treated by the platform as published and available to buyers. Draft, expired, sold, paused or removed listings may be treated differently according to the functionality shown in the seller dashboard.
Sellers may start on the free tier and upgrade when they need a higher active-listing limit. A package change takes effect at the time shown when the seller requests or purchases it. If a seller moves to a lower tier while more listings are active than that tier permits, the seller must choose which listings remain active. We may pause, hide or prevent renewal or publication of excess listings until the account is within its limit.
Where a paid package is expressly offered as an automatically recurring monthly subscription, the seller authorises the disclosed monthly charge until the subscription is cancelled. Sellers may cancel using any account facility provided for that purpose or by contacting kuier@kuieralot.com. Cancellation affects future billing from the effective cancellation date shown or confirmed to the seller; it does not retrospectively undo access already supplied. Any cooling-off, cancellation, refund or other right provided by applicable law remains unaffected.
We may change tier names, prices, limits or benefits prospectively. We will display the updated terms before a new purchase and give reasonable notice of a material change affecting an existing paid package. We will not retrospectively charge for use of a free tier or for a completed transaction.
kuieralot® Market Space currently charges no commission on a seller’s sales. Unless we expressly agree otherwise, sellers keep payments received from buyers and remain responsible for their own payment-provider charges, delivery costs, taxes and business expenses. Listing-tier fees are paid for access to the relevant platform capacity and do not guarantee views, enquiries, buyers, sales or revenue.
We may introduce optional paid promotional or enhanced services in addition to the listing tiers. Their price and any separate terms will be disclosed before a seller chooses them.
5. Creating and maintaining listings
A seller is solely responsible for each listing and must ensure that it:
- uses clear, recent and accurate photographs of the actual product;
- states the product name and a truthful, sufficiently detailed description;
- states the full selling price in South African rand and clearly discloses any additional charge;
- identifies relevant sizes, colours, materials, quantities, specifications or options;
- accurately states availability and stock;
- clearly identifies whether the product is new, handmade, refurbished or pre-owned;
- discloses every known material defect, flaw, safety concern or sign of wear;
- states the available delivery or collection methods, areas, costs and realistic estimated timeframes;
- does not contain false, misleading, deceptive or unverifiable claims;
- does not misuse keywords or place a listing in an irrelevant category; and
- complies with all labelling, pricing, safety, consumer-protection, advertising and other legal requirements.
Sellers must promptly edit, pause or remove a listing if its information changes or the product is no longer available. A seller may not advertise a product it does not possess or have authority and a genuine ability to supply.
6. Publication and platform moderation
Listings may be published without prior review, approval or editing by kuieralot. Publication does not mean that kuieralot has inspected, verified, endorsed, certified or approved the seller, listing, product, price or claim.
We are not obliged to monitor every listing or communication. We may, however, investigate a listing or account and may refuse, hide, suspend or remove any listing or account where we reasonably believe that it:
- breaches these kuieralot® Market Space Terms or applicable law;
- creates a safety, fraud, reputational, technical or legal risk;
- infringes or may infringe another person’s rights;
- is misleading, inaccurate, obsolete, duplicated or in the wrong category;
- is the subject of a credible complaint or official request;
- contains prohibited content or products; or
- otherwise undermines the usefulness, safety or integrity of kuieralot® Market Space.
Where reasonably appropriate, we may ask the seller to correct a problem before taking action. We are not required to edit a listing on the seller’s behalf or give advance notice where immediate action is reasonably necessary.
7. Prohibited products and content
The following may not be offered, requested, promoted or facilitated through kuieralot® Market Space:
- illegal, stolen, fraudulently obtained or unlawfully imported goods;
- counterfeit goods or unauthorised replicas;
- weapons, ammunition, explosives or items primarily intended to cause harm;
- illegal drugs, controlled substances, drug paraphernalia or unlawful cannabis products;
- tobacco, nicotine and vaping products;
- alcoholic products;
- pornographic, sexually explicit or adult-only products or content;
- live animals, wildlife products or unlawfully obtained animal products;
- prescription medicines, unregistered medicines, controlled medical products, or products making unlawful medical or health claims;
- hazardous, toxic, infectious, flammable or otherwise dangerous substances or materials;
- financial products, credit, investments, securities, cryptocurrency schemes, pyramid schemes or get-rich-quick schemes;
- recalled, expired, unsafe or materially defective products;
- personal information, identity documents, payment credentials or confidential records;
- goods that infringe copyright, trade marks, designs, patents, privacy, publicity or other rights;
- services, vacancies, property, vehicles, event tickets or other non-product advertisements unless kuieralot has created and expressly opened a suitable category for them; and
- anything else whose sale, advertising, possession, delivery or use is prohibited or restricted by law.
This list is not exhaustive. A product that is technically lawful may still be removed if it creates an unreasonable safety, fraud or platform-integrity risk.
8. Seller responsibilities
Each seller independently operates its business and is solely responsible for:
- the quality, safety, legality, authenticity, condition and conformity of its products;
- prices, stock, quotations, invoices, receipts and transaction records;
- responding honestly and promptly to buyer enquiries;
- agreeing secure and lawful payment arrangements with buyers;
- packaging, delivery, collection, risk and any delivery insurance;
- honouring promises, warranties and agreed delivery times;
- returns, repairs, replacements, refunds, complaints and after-sales support;
- all taxes, duties, registrations, licences, permits and regulatory obligations;
- protecting buyer personal information and using it only for a lawful transaction-related purpose; and
- compliance with the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Protection of Personal Information Act 4 of 2013 (“POPIA”) and all other applicable law.
A seller must provide consumers with all mandatory supplier and transaction information applicable to an electronic sale. This may include the seller’s legal identity and status, registration details, physical and electronic contact details, full price and charges, delivery timeframe, payment terms, return and refund policy, applicable guarantees, transaction record and statutory cancellation rights.
A seller may not attempt to exclude or restrict a consumer right that cannot lawfully be excluded, including applicable rights concerning cooling-off, fair terms, quality, safety, repairs, replacements and refunds.
9. Buyer responsibilities and safety
Buyers must assess a seller and product before entering a transaction. Before paying, a buyer should:
- confirm the seller’s identity and reliable contact details;
- ask questions and verify the product’s description, condition, availability and total price;
- confirm payment, delivery, collection, returns and warranty terms in writing;
- use a traceable and appropriately secure payment method;
- avoid paying into an account whose holder cannot reasonably be linked to the seller;
- keep the listing, messages, proof of payment and transaction records; and
- take sensible personal-safety precautions when meeting for collection.
Buyers may not make false enquiries, submit fraudulent proof of payment, reverse a legitimate payment dishonestly, abuse a seller, misuse contact details, or use kuieralot® Market Space to facilitate an unlawful transaction.
Any price negotiation, order, payment or collection arrangement is at the buyer’s and seller’s discretion and risk, subject to their rights under applicable law.
10. Payments
kuieralot® Market Space does not collect, hold, process, guarantee or release payment for transactions between independent buyers and sellers. Any payment instruction is agreed directly between them.
kuieralot will never require a buyer to pay a kuieralot® Market Space seller through a personal message purportedly sent on our behalf. Users should be cautious of requests for passwords, one-time PINs, card details, remote device access, payment to an unrelated third party, or urgent payment outside the agreed process.
kuieralot is not responsible for assessing the security or suitability of a payment method chosen by a buyer or seller.
11. Delivery and collection
The seller and buyer arrange delivery or collection directly. The seller must clearly disclose available options, areas, charges and realistic timeframes before the buyer commits to the purchase.
The kuieralot® Shop Delivery Policy, including its R99 rate and free-delivery threshold, applies only to eligible purchases made directly from the kuieralot® Shop. It does not apply to independent Market Space listings or transactions unless expressly stated on a particular listing.
Any courier used for a kuieralot® Market Space transaction is engaged by the buyer or seller who books it. That person is responsible for appropriate packaging, declared information, restricted-goods rules, tracking, insurance and claims, subject to the agreement between buyer and seller and applicable law.
12. Returns, refunds and disputes between users
The seller is responsible for its own return and refund terms and for complying with all statutory consumer rights. The kuieralot® Shop Returns and Refunds Policy applies only to products sold directly by KUIERALOT (PTY) LTD and not to independent Market Space transactions.
Buyers should first raise a product, payment, delivery or refund dispute directly with the seller. Sellers must respond professionally, keep appropriate records and attempt to resolve valid complaints fairly and lawfully.
kuieralot is not obliged to mediate or decide a dispute between users. We may receive a report, request relevant information, preserve records where appropriate, restrict an account or listing, or refer users to an appropriate authority. Such assistance does not make us a party to the transaction or responsible for its outcome.
Users remain free to exercise any right available through a court, the National Consumer Commission, a consumer court, an applicable ombud, law enforcement or another competent authority.
13. Reviews, reports and communications
If Market Space allows reviews, ratings, reports or other user submissions, they must be honest, relevant and based on genuine experience. Users may not submit fabricated reviews, manipulate ratings, threaten a negative review to obtain an improper benefit, or publish unlawful, abusive or defamatory content.
To report a listing, seller, buyer or suspected scam, email kuier@kuieralot.com with the relevant URL, account or listing name, supporting information and a description of the concern.
We may use reasonable information supplied in a report to investigate and enforce these kuieralot® Market Space Terms. We will handle personal information in accordance with applicable law and our Privacy Policy.
14. Intellectual property and listing content
A seller retains ownership of content it submits but grants KUIERALOT (PTY) LTD a non-exclusive, worldwide, royalty-free, transferable and sub-licensable licence to host, store, reproduce, resize, format, display, distribute and promote that content for operating, improving and marketing kuieralot® Market Space and the wider kuieralot® platform.
This licence continues only for as long as reasonably necessary for those purposes, legal compliance, backups and resolving disputes. Removing a listing does not require us to retrieve content already included in lawful social-media posts, cached pages, marketing material or backups, although we will consider reasonable removal requests.
A seller confirms that it owns or has permission to use every photograph, logo, name, description and other element in its listing and that our permitted use will not infringe another person’s rights.
The kuieralot® Market Space platform, kuieralot® branding, page design and content supplied by us remain owned by or licensed to KUIERALOT (PTY) LTD. No user may scrape, reproduce, republish or commercially exploit them without written permission, except as allowed by law.
15. Personal information
We process personal information as described in our Privacy Policy and in accordance with POPIA.
A seller understands that information intentionally included in a public profile or listing may be visible to anyone. Do not publish identity numbers, banking information, private residential details or other sensitive information in a listing.
Buyers and sellers may use each other’s personal information only as reasonably necessary to discuss or complete a genuine transaction, comply with law or resolve a related dispute. They may not add one another to marketing lists, sell contact details, send spam, harass users or use information for an unrelated purpose without a lawful basis.
16. Platform availability and changes
We aim to keep kuieralot® Market Space available and useful but do not guarantee uninterrupted, error-free or permanent access. We may maintain, update, change, restrict, suspend or discontinue all or part of kuieralot® Market Space where reasonably necessary.
We do not guarantee a particular number of views, enquiries, buyers, sales or revenue, or that any user will complete a transaction.
17. Suspension and termination
You may stop using kuieralot® Market Space and remove your listings at any time, subject to completing or lawfully resolving outstanding transactions.
We may warn, restrict, suspend or terminate an account or its access to Market Space where we reasonably believe that the user:
- has breached these kuieralot® Market Space Terms or applicable law;
- poses a fraud, safety, legal, technical or reputational risk;
- has repeatedly received credible complaints;
- has misused the platform or another user’s information;
- has attempted to evade a previous restriction; or
- has been inactive for an extended period and its listings are no longer reliable.
Where reasonably possible, we will notify the user by email. We may act without advance notice where immediate action is necessary to protect users, the public, the platform, evidence or legal rights.
Termination does not affect obligations or liabilities arising before termination, including duties relating to an existing buyer, payment, delivery, return, refund or complaint.
18. Disclaimers and limitation of liability
Because listings and transactions are created and conducted by independent users, kuieralot does not warrant or guarantee:
- the identity, authority, solvency, reliability or conduct of a user;
- the existence, ownership, authenticity, legality, safety, quality, condition or availability of a listed product;
- the accuracy or completeness of a listing, price, review or user statement;
- that payment will be made or a product delivered, collected, accepted or returned; or
- that a transaction will meet either party’s expectations.
To the fullest extent permitted by law, KUIERALOT (PTY) LTD is not liable for loss arising from a transaction or attempted transaction between independent kuieralot® Market Space users, including non-payment, fraud, misrepresentation, product defects, personal injury, delivery failure, data misuse or a user’s unlawful conduct.
We do not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising from our own fraud, wilful misconduct or gross negligence, or any liability expressly imposed on us by applicable consumer law.
19. Indemnity
To the fullest extent permitted by law, a user is responsible for and indemnifies KUIERALOT (PTY) LTD against a third-party claim, loss, penalty, damage or reasonable legal cost arising from that user’s listing, product, transaction, content, unlawful conduct, infringement of rights or breach of these kuieralot® Market Space Terms.
This clause does not require a consumer to indemnify us for our own prohibited, unlawful or grossly negligent conduct and does not remove any non-excludable right.
20. Changes to these kuieralot® Market Space Terms
We may update these kuieralot® Market Space Terms to reflect changes to kuieralot® Market Space, our practices or applicable law. The updated version and effective date will be published on the Website.
If a change materially affects registered sellers, we may provide reasonable notice by email or through the Website. Continuing to use kuieralot® Market Space after the effective date constitutes acceptance of the updated terms. A seller who does not accept them must stop using kuieralot® Market Space and remove its listings.
21. Governing law and general provisions
These kuieralot® Market Space Terms are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any mandatory right to approach another competent body.
If a provision is unlawful or unenforceable, it will be severed or limited to the minimum extent necessary without affecting the remaining provisions. A delay in enforcing a right is not a waiver. These kuieralot® Market Space Terms do not create employment, partnership, franchise, agency or joint-venture relationships between kuieralot® and any user.
