kuieralot® Art Gallery Buyer Terms and Conditions

These kuieralot® Art Gallery Buyer Terms and Conditions (“Buyer Terms”) apply when you browse artwork, contact a seller or purchase artwork discovered through the kuieralot® Art Gallery at kuieralot.com/art-gallery (“Art Gallery”).

The kuieralot® Art Gallery platform is operated by KUIERALOT (PTY) LTD, trading as kuieralot® (“kuieralot”, “we”, “us” or “our”), a company registered in South Africa.

By using the kuieralot® Art Gallery to find or contact a seller, you agree to these Buyer Terms.

1. The role of kuieralot®

The kuieralot® Art Gallery is an online listing and discovery platform for independent artists and artwork sellers. Unless a listing expressly identifies KUIERALOT (PTY) LTD as the seller:

  • the independent seller, not kuieralot, sells the artwork;
  • you contract and communicate directly with the seller;
  • you pay the seller directly using a method agreed with the seller;
  • the seller arranges packaging, delivery or collection;
  • the seller handles returns, refunds, warranties and complaints;
  • kuieralot® does not hold or release payment;
  • kuieralot® does not possess, inspect, authenticate, value or insure the artwork; and
  • kuieralot® is not a party to the sale.

Publication of a listing is not an endorsement, verification or guarantee of the artist, seller, artwork, authenticity, provenance, condition, value, price or description.

2. Buyer eligibility and conduct

You must be at least 18 years old and legally capable of entering into a binding agreement to buy through a kuieralot® Art Gallery connection.

You must communicate honestly and lawfully. You may not submit false enquiries, use fraudulent proof of payment, dishonestly reverse a valid payment, impersonate another person, harass a seller or use seller information for an unrelated purpose.

3. Listings and availability

Artwork listings are created and maintained by independent sellers. A displayed artwork may have been sold, reserved, withdrawn or become unavailable before the listing is updated.

A displayed price is information supplied by the seller and does not create a sale with kuieralot. A binding sale arises only when you and the seller agree on the artwork, price, payment, delivery or collection and any other material terms.

Minor differences between an image and an artwork may result from lighting, photography, screen settings, texture, materials or handmade production. Material variations must be disclosed by the seller.

4. Checks before buying

Before paying, you should ask the seller to confirm in writing:

  • the seller’s identity and reliable contact details;
  • that the artwork is still available;
  • whether the work is an original, print, reproduction or digital artwork;
  • the artist, title, medium, year, dimensions and condition;
  • any restoration, defect, damage, wear or alteration;
  • edition size and number, signature status and certificate of authenticity, where applicable;
  • whether framing, mounting or display hardware is included;
  • the full price, including packaging, delivery, insurance and other charges;
  • the payment method and when payment becomes due;
  • delivery or collection arrangements and estimated timing; and
  • the seller’s cancellation, return, refund and warranty terms.

For a high-value artwork, consider requesting further provenance, independent authentication, a condition report, valuation or appropriate professional advice before purchase.

5. Originals, prints and editions

An original artwork is not the same as a print or reproduction. Before buying a print, confirm whether it is an open or limited edition, how it was produced, whether it is signed, and the edition number and size.

A certificate of authenticity is supplied by the seller or artist and is not issued or verified by kuieralot unless expressly stated.

Artistic reputation and market value may change. kuieralot does not provide investment, valuation or resale advice and does not guarantee that an artwork will retain or increase its value.

6. Digital artwork

For digital artwork, confirm the file format, resolution, delivery method, permitted uses and whether the purchase is exclusive or non-exclusive.

Unless the seller expressly agrees otherwise in writing, buying a digital file or physical artwork does not transfer copyright or permit commercial reproduction, resale of copies, alteration, minting, publication or distribution.

7. Payments and fraud prevention

kuieralot® does not collect, process, hold, guarantee or release payment for independent kuieralot® Art Gallery sales. You and the seller select the payment method at your own discretion, subject to applicable law.

Use a traceable and reasonably secure payment method. Verify unexpected bank-detail changes using a trusted contact channel before paying. Do not share passwords, card PINs, one-time PINs, authentication codes or remote access to your device.

Confirm that the payment-account holder can reasonably be linked to the seller. Keep the listing, correspondence, invoice and proof of payment.

8. Delivery and collection

Delivery or collection is agreed directly with the seller. Confirm who bears the cost and risk, which courier will be used, the declared value, insurance cover, packaging method, tracking and the delivery timeframe.

For collection, meet in a reasonably safe location, inspect the artwork where practical and obtain a written receipt. Do not attend an unsafe or suspicious collection arrangement.

The kuieralot® Shop Delivery Policy, including its R99 rate and free-delivery threshold, does not apply to independent Art Gallery sales.

9. Inspecting delivery

Inspect the outer packaging and artwork as soon as reasonably possible. If a parcel is visibly damaged, note this with the courier where possible and photograph the package before opening it.

Report damage, an incorrect work, missing components or a material discrepancy promptly to the seller. Keep all packaging, labels, photographs and transaction records until the matter is resolved.

10. Returns, cancellations and statutory rights

The independent seller is responsible for its cancellation, return and refund policy and for complying with applicable consumer law.

Depending on the seller, buyer and transaction, rights may arise under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or another law. These may include rights relating to cooling-off, delivery, fair terms, accurate descriptions, safe and good-quality goods, defects, repairs, replacement or refunds.

Statutory exceptions may apply to personalised, commissioned, made-to-specification or digital products and to services that began with consent. Ask the seller to explain the terms applicable to your purchase before paying.

The kuieralot® Shop Returns and Refunds Policy applies only to products sold directly by KUIERALOT (PTY) LTD and not to independent kuieralot® Art Gallery sales.

11. Problems and disputes

Raise a transaction problem directly with the seller first and clearly state the remedy you seek. Preserve all relevant listings, messages, invoices, payment records, tracking information and photographs.

You may report suspected fraud, prohibited artwork or serious seller misconduct to kuier@kuieralot.com. Include the listing URL, seller details and supporting information.

kuieralot may investigate a report and suspend or remove a listing or account, but is not obliged to mediate, decide or pay a claim between buyer and seller. You remain free to approach your payment provider, courier, insurer, law enforcement, the National Consumer Commission, a consumer court, an applicable ombud or another competent authority.

12. Prohibited transactions

You may not use the kuieralot® Art Gallery to request or purchase stolen, counterfeit, forged, pirated, illegal or prohibited artwork or material. This includes unlawfully obtained cultural property, protected wildlife products, prohibited explicit content and works infringing another person’s rights.

If you reasonably suspect that an artwork is stolen, forged, counterfeit or unlawful, do not complete the transaction and report it to the appropriate authority and kuieralot.

13. Intellectual property

The artist or rights holder ordinarily retains copyright and moral rights in an artwork. Your purchase transfers only the physical item or usage licence expressly agreed with the seller.

You may not copy listing photographs or descriptions, commercially reproduce the artwork, create or sell derivatives, or otherwise exploit protected content without permission or another lawful basis.

14. Personal information

We process personal information as described in our Privacy Policy and in accordance with applicable South African law, including the Protection of Personal Information Act 4 of 2013.

You may use seller information only to make a genuine enquiry, complete a transaction, comply with law or resolve a related dispute. You may not add the seller to a marketing list, publish private details, send spam or harass the seller.

15. Platform availability and removal

We do not guarantee uninterrupted access, that a listing will remain available, or that every seller will respond. We may suspend or remove listings and accounts where reasonably necessary for safety, legal compliance or platform integrity.

16. Liability

To the fullest extent permitted by law, KUIERALOT (PTY) LTD is not liable for an independent seller’s identity, conduct, listing, artwork, authenticity, provenance, value, condition, payment arrangement, packaging, delivery, return, refund or breach of law or agreement.

We do not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising from our fraud, wilful misconduct or gross negligence or liability expressly imposed on us by applicable consumer law.

17. Changes, governing law and contact

We may update these Buyer Terms prospectively. The version published when you use the kuieralot® Art Gallery applies to that use, while the terms agreed directly with the seller govern your sale.

These Buyer Terms are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any mandatory right to approach another competent body.
