kuieralot® Bookshelf Buyer Terms and Conditions

These kuieralot® Bookshelf Buyer Terms and Conditions (“Buyer Terms”) apply when you browse books, contact a seller or purchase a book discovered through the kuieralot® Bookshelf at kuieralot.com/bookshelf (“Bookshelf”).

The kuieralot® Bookshelf platform is operated by KUIERALOT (PTY) LTD, trading as kuieralot® (“kuieralot”, “we”, “us” or “our”), a company registered in South Africa.

By using the kuieralot® Bookshelf to find or contact a seller, you agree to these Buyer Terms.

1. The role of kuieralot

The kuieralot® Bookshelf is an online listing and discovery platform for independent authors, publishers and book sellers. Unless a listing expressly identifies KUIERALOT (PTY) LTD as the seller:

  • the independent seller, not kuieralot, sells the book;
  • you contract and communicate directly with the seller;
  • you pay the seller directly using a method agreed with the seller;
  • the seller manages the order and physical or digital fulfilment;
  • the seller handles returns, refunds, warranties and complaints;
  • kuieralot® does not hold or release payment;
  • kuieralot® does not print, publish, distribute, store or inspect listed books; and
  • kuieralot® is not a party to the sale.

Publication of a listing is not an endorsement, verification or guarantee of the author, publisher, seller, book, rights, edition, condition, price or description.

2. Buyer eligibility and conduct

You must be at least 18 years old and legally capable of entering into a binding agreement to buy through a kuieralot® Bookshelf connection.

You must communicate honestly and lawfully. You may not submit false enquiries, use fraudulent proof of payment, dishonestly reverse a valid payment, impersonate another person, harass a seller or use seller information for an unrelated purpose.

3. Listings and availability

Book listings are created and maintained by independent sellers. A displayed book may have been sold, withdrawn or become unavailable before the listing is updated.

A displayed price is information supplied by the seller and does not create a sale with kuieralot. A binding sale arises only when you and the seller agree on the book, format, price, payment, fulfilment and any other material terms.

4. Checks before buying

Before paying, you should ask the seller to confirm in writing:

  • the seller’s identity and reliable contact details;
  • that the book is available;
  • the title, author, publisher, edition, ISBN and language where applicable;
  • whether it is hardcover, paperback, audiobook or eBook;
  • whether the copy is new, used, signed, collectible or a special edition;
  • the physical condition and any wear, highlighting, annotations, missing pages or other defect;
  • the file format and device or software requirements for an eBook;
  • the full price, including delivery and every other charge;
  • the payment method and when payment becomes due;
  • delivery, collection or digital-fulfilment arrangements and timing; and
  • the seller’s cancellation, return, refund and warranty terms.

5. Physical and used books

Used-book condition is subjective, so ask for current photographs and details where condition matters. A signed-book claim, first-edition claim or other collectible attribute should be supported by reasonable evidence from the seller.

Confirm whether supplemental materials, dust jackets, slipcases, access codes, maps, discs or other components are included. A used access code may no longer work.

6. eBooks and digital content

Before buying an eBook, confirm the file format, file size, delivery method, technical requirements, territorial restrictions and permitted uses.

An eBook purchase generally grants a personal, non-transferable usage licence rather than ownership of the copyright. Unless expressly permitted, you may not copy, redistribute, upload, resell, share, alter or commercially exploit the file.

Do not purchase or download a file that appears pirated or unlawfully reproduced. Report suspected piracy to the relevant rights holder and kuieralot.

7. Payments and fraud prevention

kuieralot® does not collect, process, hold, guarantee or release payment for independent kuieralot® Bookshelf sales. You and the seller select the payment method at your own discretion, subject to applicable law.

Use a traceable and reasonably secure payment method. Verify unexpected bank-detail changes using a trusted contact channel before paying. Do not share passwords, card PINs, one-time PINs, authentication codes or remote access to your device.

Confirm that the payment-account holder can reasonably be linked to the seller. Keep the listing, correspondence, invoice and proof of payment.

8. Delivery, collection and digital fulfilment

Physical delivery or collection is agreed directly with the seller. Confirm the courier, cost, tracking, packaging and estimated timeframe before paying.

International sellers may dispatch from outside South Africa. Confirm the origin, delivery estimate, customs duties, import taxes and other charges before purchase.

For an eBook, confirm when and how the download or file will be supplied. Do not open unexpected files or links that appear unsafe.

The kuieralot® Shop Delivery Policy, including its R99 rate and free-delivery threshold, does not apply to independent Bookshelf sales.

9. Inspecting delivery

Inspect a physical book as soon as reasonably possible. Report damage, an incorrect edition, missing content or a material discrepancy promptly to the seller and retain photographs, packaging, labels and transaction records.

For an eBook, promptly tell the seller if the file is missing, corrupt, inaccessible, in the wrong format or materially different from the listing.

10. Returns, cancellations and statutory rights

The independent seller is responsible for its cancellation, return and refund policy and for complying with applicable consumer law.

Books, newspapers, periodicals and magazines are excluded from ECTA’s section 44 cooling-off right. This does not remove other rights that may apply when a book is damaged, defective, unsafe, pirated, incorrectly supplied or materially different from its description.

Other rights may arise under the Consumer Protection Act 68 of 2008 (“CPA”), ECTA or another applicable law, depending on the seller, buyer and transaction. Ask the seller to explain the terms applicable to your purchase before paying.

The kuieralot® Shop Returns and Refunds Policy applies only to products sold directly by KUIERALOT (PTY) LTD and not to independent kuieralot® Bookshelf sales.

11. Problems and disputes

Raise a transaction problem directly with the seller first and clearly state the remedy you seek. Preserve all relevant listings, messages, invoices, payment records, tracking information, files and photographs.

You may report suspected fraud, piracy, prohibited content or serious seller misconduct to kuier@kuieralot.com. Include the listing URL, seller details and supporting information.

kuieralot® may investigate a report and suspend or remove a listing or account, but is not obliged to mediate, decide or pay a claim between buyer and seller. You remain free to approach your payment provider, courier, insurer, rights holder, law enforcement, the National Consumer Commission, a consumer court, an applicable ombud or another competent authority.

12. Prohibited transactions

You may not use the kuieralot® Bookshelf to request or purchase stolen, counterfeit, pirated, illegal or prohibited books or files, including unlawfully scanned PDFs, unauthorised advance copies and content whose distribution infringes another person’s rights.

13. Reviews and user content

If the kuieralot® Bookshelf permits reviews or ratings, they must be truthful, relevant and based on genuine experience. You may not submit fabricated reviews, manipulate ratings, threaten a negative review to obtain an improper benefit, or publish unlawful, abusive or defamatory content.

14. Intellectual property

Copyright and other rights in a book remain with the author, publisher or rights holder. Your purchase does not permit reproduction, publication, adaptation, distribution or commercial use beyond the licence or legal rights applicable to the copy.

You may not copy listing photographs or descriptions or otherwise exploit protected platform or seller content without permission or another lawful basis.

15. Personal information

We process personal information as described in our Privacy Policy and in accordance with applicable South African law, including the Protection of Personal Information Act 4 of 2013.

You may use seller information only to make a genuine enquiry, complete a transaction, comply with law or resolve a related dispute. You may not add the seller to a marketing list, publish private details, send spam or harass the seller.

16. Platform availability and removal

We do not guarantee uninterrupted access, that a listing will remain available, or that every seller will respond. We may suspend or remove listings and accounts where reasonably necessary for safety, legal compliance or platform integrity.

17. Liability

To the fullest extent permitted by law, KUIERALOT (PTY) LTD is not liable for an independent seller’s identity, conduct, listing, book, rights, edition, condition, payment arrangement, delivery, digital file, return, refund or breach of law or agreement.

We do not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising from our fraud, wilful misconduct or gross negligence or liability expressly imposed on us by applicable consumer law.

18. Changes, governing law and contact

We may update these Buyer Terms prospectively. The version published when you use the kuieralot® Bookshelf applies to that use, while the terms agreed directly with the seller govern your sale.

These Buyer Terms are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any mandatory right to approach another competent body.
